Log Files

Fusedpage follows a standard procedure of using log files. These files log visitors when they visit websites. All hosting companies do this and are a part of hosting services' analytics. The information collected by log files includes internet protocol (IP) addresses, browser type, Internet Service Provider (ISP), date and time stamp, referring/exit pages, and possibly the number of clicks. These are not linked to any personally identifiable information. FUSEDPAGE collects the emails provided through the “Contact Us” feature of this website, so FUSEDPAGE can respond to your questions or suggestions. FUSEDPAGE also collects emails sent through the website for security purposes, to allow the recipient brokers and salespersons to view your email, to send you communications you have opted-in to receive, and for management of your website account.

We may disclose your personal information to our service providers if we have a written contract with each of them. Each service provider is a for-profit organization that processes data on our behalf.

In the previous twelve (12) months, Fusedpage did not disclose or sell any personal information to third parties for business or commercial purposes. Fusedpage will not sell personal information about website visitors, users, or other consumers in the future.

Intellectual Property Claims (Copyright (DMCA), Trademark Infringement)

REPORTING CLAIMS OF COPYRIGHT INFRINGEMENT

Fusedpage's content is based on User Generated Content (U.G.C.). Fusedpage does not check user uploaded/created content for copyright violations or other rights. However, if you believe any uploaded content violates your copyright or a related exclusive right, you should follow the process below. Fusedpage looks into reported violations and removes or disables content shown to be violating third-party rights.

To allow us to review your report promptly and effectively, a copyright infringement notice ("Notice") should include the following:

  • Identification of your copyrighted work and what is protected under the copyright(s) that you are referring to
  • Your copyright certificate(s)/designation(s) and the type, e.g., registered or unregistered
  • Proof of your copyrights ownership, such as the registration number or a copy of the registration certificate
  • A short description of how our user(s) allegedly infringed (s) your copyright(s)
  • Clear references to the materials you allege are infringing and which you request to be removed.
  • Your complete name, address, email address, and telephone number.
  • A statement that you have a good faith belief that the use of the material in the manner complained of is not authorized by the copyright owner, its agent, or the law.
  • A statement made under penalty of perjury that the information provided in the Notice is accurate and that you are the copyright owner or the owner of an exclusive right that is being infringed or are authorized to make the complaint on behalf of the copyright owner or the owner of an exclusive right that is being infringed.
  • Your electronic or physical signature

Note that we will provide the user allegedly infringing your copyright with information about the Notice and allow them to respond. In cases where sufficient proof of infringement is provided, we may remove or suspend the reported materials before receiving the user's response. In cases where the allegedly infringing user provides us with a proper counter-notification indicating that it is permitted to post the allegedly infringing material, we may notify you and then replace the removed or disabled material. We will act under 17 U.S.C. Section 512 and other applicable laws in all such cases.

You must comply with all of the requirements of Section 512(c)(3) of the DMCA to ensure your DMCA Notice is adequate.

Please be aware that if you knowingly misrepresent that material or activity on the Website infringes your copyright, you may be held liable for damages (including costs and attorneys' fees) under Section 512(f) of the DMCA.

COUNTER-NOTIFICATION PROCEDURES

Suppose you believe that the material you posted on the site was removed or access to it was disabled by mistake or misidentification. In that case, you may file a counter-notification with us (a "Counter-Notice") by submitting a written notification to our DMCA / Copyright Claims agent (identified above). However, if you believe any uploaded content violates your trademark, you should follow the process below. Fusedpage looks into reported violations and removes or disables content shown to be violating third-party trademark rights.

In order to allow us to review your report promptly and effectively, a trademark infringement notice ("T.M. Notice") should include the following:

  • Identification of your trademark and the goods/services for which you claim trademark rights
  • Your trademark registration certificate and a printout from the pertinent country's trademark office records show the current status and title of the registration. Alternatively, a statement that your mark is unregistered, together with a court ruling confirming your rights
  • A short description of how our user(s) allegedly infringe(s) on your trademark(s)
  • A statement that you have a good faith belief that the use of the material in the manner complained of is not authorized by the trademark owner, its agent, or the law.
  • A statement made under penalty of perjury that the information provided in the Notice is accurate and that you are the trademark or are authorized to make the complaint on behalf of the trademark owner
  • You can submit the Notice electronically to Admin@fusedpage.com or submit a ticket to our Trademark Complaint representative here.

Note that we will provide the user who is allegedly infringing your trademark with information about the T.M. Notice and allow them to respond. In cases where sufficient proof of infringement is provided, we may remove or suspend the reported materials before receiving the user's response. In cases where the allegedly infringing user includes information indicating that it is permitted to post the allegedly infringing material, we may notify you and replace the removed or disabled material. In all such cases, we will act in accordance with applicable law.

REPEAT INFRINGERS

It is our policy in appropriate circumstances to disable and/or terminate the accounts of users who are repeat infringers.

Fusedpage will not use or disclose personal information for purposes other than those for which the information was collected, except with the customer's consent or as required by law. Fusedpage will only retain personal information for as long as is necessary to fulfill the purposes for which it was collected and/or to comply with any legal requirements. Fusedpage retention standards meet these requirements. Fusedpage will destroy personal information when it is no longer reasonably required.
